二、租赁期限及费用
- 租赁设备的租赁期自年月日至年月日，共计个月。如提前交付或迟延交付，租赁期间自实际交付之日起计算。

租金支付方式：租金按每月固定金额支付，从租赁设备进场之日起开始计算至乙方通知退场之日起第三日止。若超出一个月，则按每日元/小时计收租金。

- 双方可协商调整租赁价格，但不可随意变更设备使用地点或时间。
三、租赁权利保证及转租转让
- 甲方保证对本合同租赁设备拥有合法的出租权利；
- 乙方在未取得甲方书面同意的情况下，不得将本合同租赁设备进行转租或转让。
- 若乙方未取得甲方书面同意，则不得变更本合同租赁设备的使用工地。
四、租赁设备工作时间及操作
- 设备正常工作时间为小时/月以内（以设备计时器读数为准），超过元/小时计算，该数据于每月租金支付日核对一次，当月核算，与租金一同支付。**
- 乙方不得强令甲方租赁设备操作人员冒险违章操作。对于不符合技术安全要求的操作行为，设备操作人员有权予以拒绝。
五、租赁设备保管及运转费用
- 乙方自本合同租赁设备进场之日起承担设备保管责任，为甲方提供安全的食宿。
- 因乙方保管不当造成的租赁设备损坏或丢失，由乙方全额负责赔偿。
- 乙方承担租赁设备运转所需的燃油费用。
- 如乙方认为甲方提供的设备操作人员严重不称职，不能完成乙方工作任务，则乙方可要求甲方在日内更换设备操作人员。
六、违约责任及损失承担
- 甲方未能按时进场的，每延迟一天向乙方支付违约金元，超过天数的，乙方可解除合同。

乙方未能足额支付租金及进退场费用的，按欠付数额的元向甲方支付违约金，超过天未足额支付，甲方可解除合同。

若因甲方设备操作人员违规操作（包括未持证操作）导致的损失由甲方承担；
- 因乙方强令冒险违章作业或指挥失当导致的损失由乙方承担。
七、争议解决
双方因履行本合同所产生的任何争议均应由中华人民共和国劳动关系处理地人民法院管辖。
八、其它条款
- 本合同一式两份，甲乙各执一份。自签订之日起生效。
- 甲方有权在合同有效期间要求乙方支付各项费用；乙方则不得干涉甲方的正常运营
